Terms and Conditions

In the following terms & conditions “the photographer” shall mean Hiromi Couzens trading as Hiromi Photography. “The clients” shall be  the person booking the photography session. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing. 

 COPYRIGHT

The copyright Designs and Patents Acts assign the copyright of the images to the photographer.  Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer in writing. Our clients can however print, display our photos for personal use only. It will be a fee to use as a business material.  All digital images remain the property of the photographer. Under no circumstances will the photographer hand over any RAW files.

DISPLAY

The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in social media, advertising, brochures, magazines and websites.

 BOOKINGS

Bookings can be made by email. All bookings require either a deposit or full payment at the time of booking to hold the date and time requested. On receipt of the required payment and final availability check, you will receive confirmation of your booking and a receipt for your payment.

 CANCELLATIONS

Cancellations made 7 days before the scheduled session start time are eligible for a 100% refund. Cancellations made 7 days after the scheduled session start time are eligible for a 50% refund. Cancellations or no shows within the 48 hour period prior to their session will not receive any refund under any circumstances and are non-transferable.

For Mini photography session, cancellations within 7 days of the scheduled session start time are eligible for a 50% refund. Cancellations within the 24 hour period prior to the session will not receive any refund.

 RESCHEDULE

Bookings can be rescheduled within the 7 days period prior to the original event date, this will incur a date rescheduling fee of GBP 30.

 PAYMENT

50% of full fee will be paid as a booking fee in advance. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due. The booking fee secures the time and services of the photographer for the shoot.

For Mini photography session, full payment will be paid in advance.

CREATIVE LICENSE, COVERAGE AND REPRODUCTION

Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements. Special requests are not binding instruction, although every effort is made to comply with the client's wishes. The Photographer will do their best to honour the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather an the availability and willingness of subjects.

FORCE MAJEURE

For the family session, If the weather isn’t suitable this will be decided by Hiromi Photography and a suitable date will be arranged. In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid. If the client(s) have to cancel a booking, the cancellation fees will be charged 50% of original fee. All cancellations must be in writing.

DELIVERY

The photographer will endeavour to deliver digital negative files as quickly as possible. However this could take up to 2 weeks during busy periods.

 REFUND

The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.

COMPLAINTS

Any complaints should first be raised by the client with the photographer in writing within 14 days from the date of receipt of images.
